Terms of Service

These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By visiting our website, purchasing a subscription, or receiving services from us, you agree to these Terms. If you do not agree, do not use our website or services. These Terms are intended to be clear, fair, and legally binding.
1. Description of Services
We provide subscription-based WordPress services that may include website design, theme and plugin configuration, hosting, maintenance, and support. We also create and manage custom WordPress plugins. Our model is ongoing service, not one-time builds. Pricing reflects both the initial setup and continued care of your website.
2. Subscription Term and Commitment
All website plans require a minimum twelve (12) month commitment (“Initial Term”). This commitment covers the cost of design, setup, hosting, and monthly support that begins on day one. After the Initial Term, your plan renews month-to-month unless canceled according to these Terms.
3. Early Cancellation
If you cancel before the end of the Initial Term, the remaining balance for the full twelve months becomes immediately due. This protects the time, cost, and resources invested in your project from the start.
4. Payment Terms
You authorize us to charge your payment method for monthly subscription fees and approved add-ons. A valid credit card must remain on file. Payments are due on the billing date shown at signup. If a payment fails, you agree to update your method within five (5) days. We may suspend services for non-payment and pursue collection efforts, including legal action, if necessary.
5. Ownership and License
You own the content you supply, such as text, images, video, and branding. We own our proprietary code, processes, and custom plugins. Certain third-party themes or plugins used in your site are licensed to you under their own terms. After completing the Initial Term and paying all amounts due, you may request a copy of your content. Migration assistance may be available as a separate paid service.
6. Website Transfer and SEO
Moving a website can affect search engine rankings. If you transfer your site to a different provider after the Initial Term, you understand SEO may change. Your new provider should manage redirects, metadata, and other SEO tasks to reduce impact.
7. Support and Availability
Standard support is available Monday through Friday, 9:00 AM to 5:00 PM (Arizona time). We aim to acknowledge requests the same business day. Urgent outages are prioritized. Plans include monthly support time as stated on our website or agreement. Unused time does not roll over.
8. Acceptable Use
You agree not to use our services for illegal, harmful, or abusive activity. Do not post or transmit content that infringes intellectual property rights, invades privacy, spreads malware, or violates law. We may remove content or suspend service if we reasonably believe a violation has occurred.
9. Third-Party Services
We may recommend or configure third-party tools (for example, payment processors, form services, analytics, or email tools). Those services are governed by their own terms and privacy policies. We are not responsible for failures or actions of third parties.
10. Disclaimers and Limits of Liability
We work to keep your site secure and online, but no system is perfect. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness, non-infringement, and uninterrupted service. We are not liable for lost profits, lost data, or indirect damages. Our total liability for any claim is limited to the fees you paid in the six (6) months before the event giving rise to the claim.
11. Changes to the Terms
We may update these Terms as needed. If we make a material change, we will post the update and may notify you by email. Continued use of the services means you accept the changes.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Arizona. Any dispute will be brought exclusively in state or federal courts located in Maricopa County, Arizona.
